Terms of Service

The rules for using LeadForGrow, what you can expect from us and what we expect from you.

These terms are an agreement between ScaleDesk Technology Pvt Ltd ("we", "us") and the business or person who creates a LeadForGrow account ("you"). By creating an account or using the service you accept them. If you accept on behalf of a company, you confirm you are authorised to do so.

1. The service

LeadForGrow is software for managing WhatsApp Business conversations, automation, campaigns, sales and payments. It works with the WhatsApp Business Platform provided by Meta. We are an independent company and are not affiliated with, endorsed by or sponsored by WhatsApp or Meta.

2. Your account

  • Provide accurate information and keep it up to date
  • Keep credentials confidential and tell us promptly about unauthorised use
  • You are responsible for activity under your workspace, including by team members you invite

3. Using WhatsApp responsibly

You must follow the WhatsApp Business Terms of Service, the WhatsApp Business Messaging and Commerce Policies and applicable law. In particular:

  • Only message people who have opted in to hear from you on WhatsApp, and honour opt-outs
  • Do not send spam, unlawful, deceptive, harassing or prohibited content
  • Do not use the service for prohibited categories under Meta's policies
  • You are responsible for your message templates and for Meta's charges and decisions about your account, including limits, quality rating and suspension

4. Acceptable use

Do not misuse the service: no attempts to breach security, overload or reverse engineer it, no illegal activity, no infringing others' rights, and no reselling or white-labelling the service except under a written partner agreement.

5. Plans, fees and taxes

  • Paid plans are prepaid for the period you choose (1, 3 or 12 months) and do not renew automatically
  • Prices are shown in Indian Rupees before GST; 18% GST (or the rate applicable at the time) is added at checkout
  • Changing to a different plan during a paid period credits the unused value of the current plan, as shown before you pay
  • If a paid plan ends without renewal, the workspace moves to the free plan after a short grace period; your data is kept but plan limits apply
  • Meta's charges for WhatsApp messages and any fees charged by Razorpay on payments you collect from your own customers are separate from our fees and are your responsibility

6. Your data

You own your workspace data. You give us permission to process it only to provide and support the service, as described in our Privacy Policy. You are responsible for having the rights and consents needed to upload it and to message your contacts. You can export contacts and deals, and you can ask us to delete your workspace.

7. AI features

AI-generated replies may be inaccurate or incomplete. You are responsible for configuring the AI agent, reviewing its output and deciding where it is appropriate to use. Do not rely on it for legal, medical, financial or other high-stakes advice to your customers without human review.

8. Third-party services

The service depends on third parties such as Meta, Razorpay, Anthropic and hosting providers. We are not responsible for their availability, changes or decisions, though we will work with you to resolve issues.

9. Availability and support

We work to keep the service available but do not guarantee uninterrupted operation. We may perform maintenance and will try to give notice of planned downtime. Check system status.

10. Suspension and termination

You may stop using the service at any time. We may suspend or terminate access if you breach these terms, put the service or others at risk, or where required by law or by Meta. Where reasonable we will tell you first.

11. Disclaimers

The service is provided "as is" and "as available". To the extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose and non-infringement.

12. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or loss of profits, revenue or data. Our total liability for any claim relating to the service is limited to the fees you paid us in the twelve months before the event giving rise to the claim. Nothing limits liability that cannot be limited by law.

13. Indemnity

You will indemnify us against third-party claims arising from your content, your messaging practices or your breach of these terms or of Meta's policies.

14. Governing law

These terms are governed by the laws of India. Courts having jurisdiction at the location of our registered office have exclusive jurisdiction, subject to any mandatory rights you have.

15. Changes and contact

We may update these terms; for material changes we will give notice. Continued use after the effective date means you accept them. Questions: support@leadforgrow.com.
